Because it's not bro. The H&S you pointed out does not have a clearly defined failure points that makes the formation valid. In this case they're too close. You just have to pull down to the M5 to see there's nothing that resembles that formation.
The only formation which suggests a bullish reversal pattern on the chart is the fry pan bottom, or rounded bottom. Watch for the m5 double top which is forming tho, if it creates a new lower low, then the fry pan bottom will likely be invalidated.

looks like we're going lower. secondary W1 supp level seems like a reasonable target @5590. Below that then it's the monthly pvp @5420.
Let's see how this goes.

Frankfurt high at 15709 hasn't been breached yet, whereas price just peeked it's head below the frankfurt low of 15654. I know this might seem trivial but I think it's important.
