You are right on the bold part and it could be challenged again. But once again, it is for the ECB and ECJ (and on that very technical matters ECJ will rely on the ECB expertise) to decide, not for any political parties (be it German). If they continue this institutional guerrilla (and it is) the answers will be less diplomatical and Angela will finish her european political career in a pitiful manner.
