Sure, they could pick anybody, even an independent that got less electoral votes than the other two. Didn't get what you meant about the Supreme Court coming into the picture though..

it would be challenged through supreme court, is my view (spirit of law one man one vote, majority wins if 270 not met).. that may buy time. if the supreme court decided to hear the case. they may not render a decision until new congress has been sworn in. or could take could/would it take place with current. between those 2 congresses faces may change. a even number on supreme court could end deadlocked.
