Sorry about that Yunden, the only way I can help is to share this to the world. And I've started with them (forex.com). The world most know about this.
There are SO MANY better brokers out there than forex.com! why would you choose this broker of all the better possibilities out there
All posts are my personal opinion
Looks bad no matter how you look. If a broker is serious then client should never be able to arb. In general if the price is there then broker should be responsible for it.

This is the answer 100%. If a copy of the same trades on another broker at the same time can be produced and they are within a profitable strategy then all accusations of benefiting from an arbitrage strategy are nullified. Case closed.

(Except if there is unusual lot size deviation which may indicate there is knowledge of price difference).

Next time trade with an ECN broker. They are a little bit better. Did FOS give you a timeline as to when they will render a decision? They cannot make you wait forever. I don't about the laws of your country but in most of the countries, there is a what's called a Statue of Limitation, which is how long since the wrongdoings happened that you can file a lawsuit against the other party. So if they take too long to give you a decision and that decision is not to your favour, you might lose your chance to take Forex.com to court due to this Statue of Limitation. If I were you, I would consult with my lawyer to find out 1) this Statue of Limitation and 2) FOS timeline
