Can one patent a trading strategy?

OK, so this has developed into the pro's and con's of having a trade explorer... I've been running them for 18 months, the good, bad and downright losers, for anyone to see.

Currently looking good.

Its only a zero sdum game in that the buys cover the sells and visa versa... however the real fact is that some people win a lot, and a lot of people lose some... and theres nothing equal in that.

Its the continual NEW money that makes it an uneven sum game in reality... just like a ponzi scheme. The difference between Forex and a Ponzi like printing US$'s is that theres always new players willing to enter.

If your strategy is so good, you would learn to program it yourself... think about it, you are going to become a multi millionaire in 5 years trading, wouldn't you learn to program code (3 to 6 months) to do that?

If I was you Wannaberich, I'd just trade the strategy quietly until I had made a million, then I'd decide what to do next...

possible options:

1. trade on and make 10 or more millions
2. learn to code to protect your invention, but from who?

you haven't exactly said why you want to protect an idea?

Must be an EA, otherwise there is no reason to protect it from programmers... EA's are a dime a dozen, and they all crash n burn ultimately, so if I was you I'd just trade it and make some money.

Patent for trading then everyone who have a system that works will apply for patent then they will accuse other people that they are using their patented idea...There would be no trading but more of suing each trader more of trading in the court.

I think EA can be patented however they would just add or remove one detail from it and the patent is breach.
For idea that would be close to impossible.

Exactly... if one wants to protect ones trading strategy, one simply keeps it to ones self.

Software patents are a ridiculous notion and stifle innovation as code is very abstract by nature; if you were to patent your trading strategy, then you'd have to disclose the methodology into the public domain.


This is incorrect - as soon as you file, a countdown starts and each year you incur greater filing costs. It's better to build, rebuild and then file a provisional patent to get a priority claim date. You can't patent something you haven't built because the claims need to encompass the utilitarian functionality and the first claim is the crux of any patent, so it's best to prototype with NDA's if using 3rd parties and then file a provisional patent once you have a definitive prototype.

The above I learned the hard way by filing a patent first and the costs became so prohibitive that it took money away from prototyping and into the pockets of expensive patent attorneys - who are just yes men.

To summarise the OP, yes you can patent a trading strategy but it will then be public domain, so anyone can use that info and depending on your territorial jurisdiction, you wouldn't have rights in some corners of the Earth...unless you have very deep pockets; just keep it to yourself and don't feed the patent machine.

Where on earth are you going to get the funds to file for patents worldwide?

You may patent your system in America only to have people copying and using it in 160 other countries around the world. Do you have the money to go to all those countries and go thru their court systems? NO NO NO.

If you were stupid enough to charge me in Australia, and take it to court, you would need airfares and acommodation here for the court case, not to mention having to hire Australian attourneys to fight your case.

On the day of the case, I could ask the judge for a delay, in which case you'd have to either extend your stay here or fly home and come back at a later date, upon which I may apply to the court to adjorn the case again on some technicality... I guarrantee you will not bother any more and just forget it ever happened, in which event it will be "case dismissed".

Maybe you'd decide to take me thru your American court system, in which case you'd be paying for all my airfares and stay costs ... that is if I deign to go. I guarrantee your court is not going to have me extradicted just because I traded your system, patented or otherwise.

And like others have said, in applying for a patent you are placing your system or code if its an EA in the public eye.

BEST ADVICE... just trade your system and get rich.
