Places I worked at, if someone was disgruntled, the worse they could do was to run up long distance charges.

Think of what a disgruntled employee could do to an account.

I think this guy was just taking the piss. If it was so easy, everybody on elance would offer to trade for a living instead of designing sites.

the key being "not using others money"

once you do that, you are free to run this as any normal business, and your choice of how to do that should be done with a lawyer, although i would open as a c corp, with some thought to an LLC. Differences being LLC is taxed as a partnership, with you having to reveal taxable income, while even with its "double taxation" problems, a c corp allows you to take $1.00 a year, but still partake of all the "goodies" the corporation will provide for you, such as a house, car, airplane and yacht, although you will not own them.

using "independent contractors" solves many problems, especially concerning taxes as they are responsible for that situation --- you simply send out their forms at the end of the year, write off the salaries and whatever and thats it for the accounting end.

once you take ANYONE elses money, you enter into a "slippery" situation, although what you will probably make will not really interest the IRS overly.

If you are remarkably successful, THEN you better cover your nether regions with lawyers, accountants, a home in geneva and the caymans, and all the usual stuff.
