Copyrighting Trading techniques

I was talking to a friend and he said once you have a solid "TRADING TECHNIQUE" you can copyright the name or Technique. I dont think it is possible but Just want to know more about it.

Doubt it is possible, but...

For you to copyright a 'trading technique' you would have to make it public, if it worked then that is the last thing you would want to do.

You could probably trademark the name of the system like, My Big Forex System (TM), etc. Look at what Tom DeMark did with his indicators.

You could also copyright the written description of the system: ie. the book or website could be copyrighted.

It's probably best to check with a lawyer.

You can apply for a trademark online for a unique name. You can't copyright the technique. If that were possible, I'd copyright this weight loss technique: eat less and exercise more!

A very good Idea!

I have a breathing technique - its keeping me alive all these years since birth. I consulted a lawyer about it and he told me to file a copyright.

So I went to the National Library, named the copyright as "Inhale, Exhale through the nose and mouth". They told me I was the first to file the right and therefore, NO ONE SHOULD BREATH THIS WAY.

National Library will post this right and warning to everyone in the world - "THOU SALT NOT BREATHE THROUGH NOSE OR MOUTH"! If you want to breathe this way, pay royalty of $1 per day to BK. Otherwise, Inhale exhale through other means, ie through a$$hole.

Hmm! The Intelectual Property Rights violators will surely violate this. But then again, they will breathe in farts! DAMN! That will punish them for violating this Copyright.

It is very possible. I have my trading code registered with the US copyright agency. By US law, orignal works are protected whether registered or not but registering does afford you more legal protection which, unfortunately, I almost had to use.

There's not much point in registering but my kids thought it was cool and I'm on the books so to speak.

i took an intellectual property course in my undergrad

here are some facts:

1) anything you put into storable medium (paper & ink, software, sheet music) is already copyrighted the minute you create it
2) even though your work may be copyrighted, you can not sue for copyright infringement unless the copyright has been registered

3) math algorithms and naturally occuring phenomenon (fire, water) can not be patented or copyrighted (i think the rules of a trading system fall under this category)
4) the APPLICATION of a math algorithm or natural phenomenon can be patented (the trading software that implements the algorithms)

This is generally true for all western nations...

However, you can copyright or more accurately TradeMark a name of a technique / brand if it is unique and not in common practice. "Google" as a name is reserved world wide, however, the term "Google It" or "Google Something" was put in a number of dictionaries as a colloquial term. Google fought to have it removed, as the acceptance of the term as common language could have actually challenged their right to TradeMark their name or its use for their own purposes in some countries.

However, copyrighting the technique itself is very hard, because it could be easily proven that almost all techniques are sampled from literature from some point in time in the past of which then you would have to pay royalities for.

Anything to do with candles, candle patterns, price action or any common indicators (MAs, stochs, MACD, RSI etc....) would have to have an extremely unique way of using them in order for you to prove that this is your own technique.

Lastly a generalisation.... The less likely other traders use your technique, the less likely the market moves in your desired direction.

i.e
The smaller the volume of the buyers, the less likely the market will move in YOUR BUYING direction.
The smaller the volume of the sellers, the less likely the market will move in YOUR SELLING direction.

So, I would suggest taking a common technique and maybe tweaking it is the way to go (which would be impossible to copyright) but would be possible to put a trademark name to it.


Programming (APPLICATION) the technique is a different story...
