Starting 1 November 2025, the Securities Commission Malaysia (SC) will enforce stricter Guidelines on Advertising of Capital Market Products & Services. If you promote unlicensed brokers/investment platforms, BEWARE – violations can result in:
- Fines up to RM10 MILLION (~USD 2.1 million)
- Jail time up to 10 YEARS
- Or BOTH!
WHAT COUNTS AS A VIOLATION?
Sharing referral links for brokers/platforms NOT LICENSED by SC/Bursa Malaysia.
Creating promotional content (TikTok, IG Reels, Webinars, etc.) encouraging sign-ups/deposits with unlicensed foreign brokers.
Social media posts highlighting benefits of illegal brokers (e.g., "High bonuses," "1:1000 leverage," etc.).
Note: Even if you aren’t paid, the SC may classify you as an "advertiser" if you spread promotional material.
WHY IS SC TIGHTENING THESE RULES?
- Protect investors from misleading info by unethical finfluencers/agents.
- Prevent scams like Ponzi schemes, "clone" brokers, or unregulated offshore platforms.
- Ensure only licensed brokers (e.g., Rakuten Trade, Maybank Invest, Kenanga) are promoted.
SAFETY MEASURES FOR YOU:
- CHECK BROKER LICENSE
- Verify via SC Licensed List or Investor Alert List.
- Offshore brokers (e.g., Binance, Deriv, OctaFX) ARE NOT SC-REGULATED – promoting them risks penalties.
- FOCUS ON EDUCATIONAL CONTENT
- Discuss market analysis, trading basics, or finance tips WITHOUT encouraging sign-ups/deposits.
- Avoid naming unlicensed brokers, even indirectly.
- OBTAIN CMSRL APPROVAL
- To legally promote financial products, register as a Capital Market Services Representative Licence (CMSRL) holder or partner with licensed firms.
- DECLARE SPONSORSHIPS (IF APPLICABLE)
- If paid, label posts as "Paid Promotion," but this ISN’T ENOUGH if the broker lacks an SC license.
DON’T TAKE THE RISK!
Many finfluencers/affiliates unwittingly break the law. The SC now uses AI & social media monitoring to track illegal activity.
