That is exactly what the EA does.
It looks at the Candle Color
It looks to see if there is a 3sema dot within 4 candles from it.
It looks to see if that same candle hit the pivot above or below it.
All this is checked right at the open of the next candle. Remember Dredding said everything is done at the close of the candle. So right at the open of the next candle the EA looks at the previous candle to see if all conditions are met.
But what exactly is a failed pivot? Based on what I was reading this is what I come up with. See image:
